The Case
Federal prosecutors charged Theranos founder Elizabeth Holmes with conspiracy and wire fraud arising from representations to investors and patients about the company's blood-testing technology, commercial relationships, financial condition, and laboratory operations. The trial began with jury selection on August 31, 2021. Holmes testified in her own defense before the evidentiary phase ended in December.
On January 3, 2022, the jury convicted Holmes on one investor-fraud conspiracy count and three investor wire-fraud counts, acquitted her on four patient-related counts, and returned no verdict on three other investor counts. Those unresolved counts were later dismissed. Holmes received a 135-month prison sentence, and the Ninth Circuit later affirmed the convictions, sentence, and restitution.
